Effective date: 3 November 2026
These Terms and Conditions govern your use of this website and the marketing services provided by Pratishtha (“Pratishtha”, “we”, “us”) to you (“client”, “you”). By using this website, requesting an audit or paying for a service, you agree to these terms.
1. Our services
Pratishtha provides marketing services for practitioners, including branding, website design, Google Business Profile setup, social media content and management, search engine optimisation, advertising management, WhatsApp follow-up setup, certificates and course or webinar launch support. The exact work, deliverables, timelines and fees for you are set out in the written proposal we send after your free practice audit. The proposal and these terms together form our agreement once you accept it and make the first payment.
2. Free practice audit
The audit is free and carries no obligation. It is based on the information available to us and is our professional opinion, not a guarantee of any result.
3. Fees and payment
- All prices are in Indian rupees and exclude GST, which is charged at the applicable rate (currently 18%).
- One-time work is paid in three parts: 40% to start, 40% on design approval and 20% before launch.
- Monthly plans are paid in advance. Monthly plans have a 3-month minimum term, after which either side may end the plan with 30 days’ written notice.
- Bundles carry a 15% discount on the individual rates.
- Advertising spend is separate. You pay it directly to the advertising platform, and media buying is charged as per actual spend.
- Third-party costs such as domain names, hosting, paid tools and stock content are charged as stated in your proposal.
- If a payment is late, we may pause work until it is received.
4. What we need from you
- Accurate information, content, photos and approvals within a reasonable time. Delays on your side can move delivery dates.
- Access to the accounts needed for the work, such as your website, domain, social media pages and ad accounts.
- You confirm that you own or have the right to use everything you give us, including your name, photos, testimonials and certificates, and that your services and claims are lawful and truthful.
- Ads, posts and web content must follow the law and the rules of each platform. We may refuse or remove content that is misleading, unlawful or against platform rules, including claims that promise guaranteed cures, results or income.
5. Ownership
Once you have paid in full for a deliverable, your website, domain, social media accounts, brand assets and content created for you belong to you. We keep ownership of our own tools, templates, methods and any material we created that is not specific to you. Unless you ask us not to, we may mention that you are a client and show non-confidential, publicly available work in our portfolio.
6. Certificates
Certificates we help you set up or issue are programme or participation certificates. They are not academic degrees, professional licences or government accreditation, and must not be presented as such.
7. No guarantee of results
Marketing results depend on many things outside our control, such as your field, city, budget, competition, the quality of your service and changes made by platforms like Google and Meta. We do not guarantee search rankings, followers, enquiries, bookings, sales or income. We will report real numbers each month.
8. Third-party platforms and tools
Our work relies on third-party platforms and tools. Their rules, prices, outages and policy changes are outside our control, and we are not responsible for suspensions, restrictions or removals imposed by them, provided we followed their rules in our work.
9. Confidentiality
Each side will keep the other’s non-public business information confidential and use it only for the purpose of the work, except where disclosure is required by law.
10. Limitation of liability
To the extent allowed by law, Pratishtha is not liable for indirect or consequential loss, including loss of profit, income, goodwill or data. Our total liability for any claim relating to our services is limited to the fees you paid to us for the service in the three months before the claim arose.
11. Ending the agreement
You may end a monthly plan after its minimum term with 30 days’ written notice. Either side may end the agreement if the other seriously breaches these terms and does not fix the problem within a reasonable time after written notice. Fees for work already done and amounts due up to the end date remain payable. Our Refund Policy explains refunds.
12. Privacy
How we handle personal information is explained in our Privacy Policy.
13. Governing law
These terms are governed by the laws of India. Any dispute will first be discussed in good faith, and if it is not resolved, it will be subject to the courts of competent jurisdiction in India.
14. Changes and contact
We may update these terms from time to time. The latest version is always on this page with its effective date. Changes do not affect a proposal you have already accepted. For any question, please contact us through the free practice audit form on this website.
